The Chicago International Dispute Resolution Association was invited to attend a luncheon on April 24, 2008 at Jenner & Block, LLP. The featured speaker was Teresa Cheng, SC, President of The Chartered Institute of Arbitrators. Ms. Cheng discussed the “Possibilities of Combining Arbitration and Mediation: The Perils and Opportunities.” Our host for the event was Lawrence S. Schaner, a partner with the law firm of Jenner & Block LLP and Chair of the Firm’s Arbitration: Domestic and International Practice.

Professor Margaret Moses discusses her new book: The Principles and Practice of International Commercial Arbitration (Cambridge University Press). Margaret L. Moses is Professor of Law at Loyola University Chicago School of Law. She teaches international commercial arbitration, international business transactions, European Community Law, international trade finance and contracts. Professor Moses is also Director of the International Program at Loyola and coaches the Vis Moot International Arbitration teams which compete annually in Vienna and Hong Kong.

Our host was the John Marshall School of Law. Our featured speaker at this meeting was Ramon Mullerat, O.B.E.

Mr. Mullerat discussed the culture and attitudes of EU-area lawyers and arbitrators towards arbitrating and mediating business disputes.


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Friday, July 20, 2007, 8:00:00 AM, at One South Wacker Drive, 28th Floor, Chicago, IL 60606. Our host was Schopf & Weiss LLP. Our featured speaker at this meeting was David W. Rivkin.

The program will feature David W. Rivkin, a litigation partner in the New York and London offices of Debevoise & Plimpton LLP. Mr. Rivkin has represented companies before virtually every major arbitration institution, including the ICC, ICDR, LCIA and ICSID. He also represents foreign businesses in litigation in the US over enforcement of arbitral awards and arbitration agreements. One of the top international dispute resolution practitioners in the world, Mr. Rivkin currently chairs the 30,000 lawyer Legal Practice Division of the International Bar Association. He previously served as chair of the IBA's Committee on Arbitration and ADR, and is a member of the Executive Committee of the American Arbitration Association Board of Directors. He is a graduate of Yale and Yale Law School.

Mr. Rivkin will speak to us on "A New Paradigm in International Arbitration," taking off from a speech of the same title he delivered last month in Madrid.

A meeting of the Chicago International Dispute Resolution Association Working Group was held on Tuesday, January 30, 2007, 8:00:00 AM, at Mayer, Brown, Rowe & Maw, 71 South Wacker Drive, Chicago. Our host was Mayer, Brown, Rowe & Maw. Our featured speaker at this meeting was Jeffrey Sarles.

The program will feature Jeffrey Sarles speaking on “Arbitrating NAFTA Claims – A Golden Opportunity for Chicago International Lawyers". His remarks and the ensuing discussion will focus on the international arbitration opportunities presented by NAFTA Chapter 11. He also will address strategic considerations when representing a private party against one of the NAFTA governments and recurring issues in this specific type of arbitration.

Jeffrey Sarles is a partner at Mayer, Brown, Rowe & Maw and Co-Chair of the firm’s Supreme Court and Appellate Practice Group. He has extensive experience in representing companies in court in cases involving arbitration issues as well as in domestic and international arbitration proceedings, among others before the AAA, ICC, ICSID, Center for Public Resources and under the UNCITRAL Rules. An active supporter of arbitration as a means to resolve international commercial and investment disputes, he regularly lectures on this topic and has taught for the past decade a seminar in arbitration law at Northwestern University School of Law, where he was editor-in-chief of the Law Review.

Our host was the World Trade Center Chicago. Our featured speaker at this meeting was Thomas Panek.

Thomas Panek, President and Chief Operating Officer of the World Trade Center Chicago will discuss with us the organization, its programs and strategies to enhance Chicago’s role in world events and commerce.

Before joining World Trade Center Chicago in September 2006, Mr. Panek was the senior international trade specialist with the U.S. Department of Commerce, where he developed successful international business strategies for American companies. A strong supporter of international trade, he served in diplomatic and economic missions and received the international trade administration bronze medal for outstanding contribution to U.S. exporters. He holds a Master’s degree in international law and organization from American University School of International Service, and the Washington College of Law.


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Tuesday, September 19, 2006, 8:30:00 AM, at the University Club in Chicago, 76 East Monroe Street. Our host was the Hong Kong International Arbitration Center and Hong Kong Trade Development Council. Our featured speaker at this meeting was Dr. Michael Moser.

The presentation is entitled “Doing Business in Hong Kong & China” and will feature Dr. Michael Moser, arbitrator, mediator and partner in the Hong Kong office of O’Melveny & Myers LLP. A fluent Mandarin Chinese speaker, who has lived in China since 1980, and a published authority on arbitration in China and Asia, Dr. Moser will share his insights and extensive Hong Kong/China experience in arbitration, mediation and counsel to American companies transacting business in China. Dr. Moser is Vice-Chairman of the Hong Kong International Arbitration Centre, Co-Chair of the China Arbitration Forum, and a China International Economic and Trade Arbitration Commission (CIETAC) panel member. He has acted as arbitrator or counsel in more than 100 cases and is the first foreign national to be appointed as an arbitrator in China. A meeting of the Chicago International Dispute Resolution Association Working Group was held on Thursday, September 14, 2006, 8:00:00 AM, at One Prudential Plaza, 130 East Randolph Drive, 39th Floor. Our host was Mr. Richard Franklin of Baker & McKenzie. Our featured speaker at this meeting was Mr. Robert Briner, former Chairman of the International Court of Arbitration of the International Chamber of Commerce (Paris).

Mr. Robert Briner is also Chairman of Panel E4 of the Commissioners of the United Nations Compensation Commission in Geneva, a member of the Claims Resolution Tribunal for Dormant Accounts in Switzerland and Former President of the Iran – United States Claims Tribunal at The Hague. Furthermore, Dr. Briner is a practicing attorney and a partner in the Geneva law firm of Lenz & Staehelin.


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Tuesday, November 15, 2005, 8:00:00 AM, at 225 North Michigan Ave., Suite 1840, Chicago, Illinois. Our host was Robert Matlin, District Vice President of the AAA in Chicago. Our featured speaker at this meeting was Steve Andersen.

Mr. Andersen is the Vice President for International Development for the ICDR. The presentation is entitled “The AAA and International Arbitration.” The AAA established the International Centre for Dispute Resolution (ICDR) in 1996 to handle its international caseload. Today, ICDR has offices in New York City and Dublin, Ireland. It employs a multi-lingual staff and has a panel of over 500 international arbitrators. More than 600 new cases were filed with ICDR in 2004


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Wednesday, October 19, 2005, 8:00:00 AM, at 203 North LaSalle Street, Suite 1900, Chicago, Illinois. Our host was Stephen Schwab of DLA Piper Rudnick Gray Cary. Our featured speaker at this meeting was Stephen Schwab.

Mr. Schwab is an International Bar Association delegate to the Hague Conference on Private International Law, Special Commission on Jurisdiction, Recognition and Enforcement of Foreign Judgments in Civil and Commercial Matters. He will comment on his participation in the negotiations surrounding the Hague Convention on the Enforcement of Foreign Judgments.


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Tuesday, July 05, 2005, 8:00:00 AM, at 180 North LaSalle Street, Suite 3600, Chicago, Illinois. Our host was Stuart Widman of Miller Shakman & Hamilton. Our featured speaker at this meeting was Stuart Widman.

The presentation is entitled "Managing the Parties, the Lawyers, the Panel and the Hearing Process." Key to ensuring a smooth and fair hearing is effective management on the part of an arbitrator. From seemingly unimportant pre-hearing logistical matters to disruptive conduct during the hearing, effective management requires active planning and preparation. The presentation will address potential issues that may arise in hearing management, and how to resolve them in keeping with the overarching goal of ensuring a fair hearing.


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Monday, June 07, 2004, 8:00:00 AM, at The Plaza Club, One Prudential Building, 40th Floor, 130 East Randolph Street, Chicago, IL.. Our host was Richard M. Franklin. Our featured speaker at this meeting was David Zaslowsky.

Mr. Zaslowsky’s presentation to CIDRA is entitled "International Litigation Issues before the Supreme Court; An Overview." International litigation is a growing area of practice. An indicator of that reality is the increasing number of international litigation cases being heard by the Supreme Court. This term alone there were at least four, covering the following areas: Foreign Sovereign Immunities Act, Alien Tort Claims Act, Section 1782 and the 1982 Foreign Trade Antitrust Improvement Act.


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Wednesday, April 21, 2004, 8:00:00 AM, at the law firm of Levin Ginsburg located at 180 North LaSalle Street, 32nd Floor Chicago, Illinois. Our host was Anne C. Keays of Levin Ginsburg. Our featured speaker at this meeting was John H. Morrison. For more than thirty years, Mr. Morrison has arbitrated commercial disputes, with a very significant arbitration practice since 1990. He has arbitrated over 25 major U.S. and international commercial disputes, serving as sole arbitrator,.

Mr. Morrison’s presentation to CIDRA was entitled "Twists of Fate in Recent ICC Arbitration." He offered a first hand account of his recent participation in an ICC Arbitration.

“Report on the New Mediation Code in Thailand" a first hand account of Judge Katz's extraordinary work in Bangkok writing the new Mediation Code under the sponsorship of the World Bank.


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Friday, February 20, 2004, 8:00:00 AM, at The Plaza Club, One Prudential Plaza, 130 East Randolph Street, Chicago, 40th floor. Our host was John Levitske of FTI Consulting. Our featured speaker at this meeting was John Levitske, Jeff Litvak, Marlo Vandermore and Sean Byrne of FTI Consulting.

The speakers’ discussion was entitled "Resolving Financial and Accounting Issues in International Disputes." They discussed several actual cases in which FTI professionals served as either expert consultants, third-party neutral arbitrators, or as advisors to arbitrators, in international disputes involving complex financial, accounting, valuation or damages issues. In addition, Sean Byrne, provided information regarding the use of electronic case presentation technology.


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Wednesday, December 10, 2003, 8:00:00 AM, at Kirkland & Ellis, conference center, room 54D, Aon Center, 200 East Randolph Drive Chicago, Illinois 60601-6636 . Our host was John Morrison & William Jentes. Our featured speaker at this meeting was Ramon Mullerat.

Mr. Mullerat commented on international arbitration from his viewpoint in Spain and in the European Community, and he touched on other current topics pertaining to professionalism, including Corporate Social Responsibility.

Our host was CIDRA member Daniel P. Albers. Our featured speaker at this meeting was Merton Marks.

“Trends in International Arbitration and Mediation” Merton E. Marks reviewed trends in arbitration and mediation of importance to international businesses and their counsel. These include increased court ordered ADR; use of mandatory binding arbitration in consumer, employment and commercial contracts; recent litigation challenging such agreements; and considerations in drafting arbitration and mediation provisions in international contracts.


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Wednesday, June 18, 2003, 8:00:00 AM, at Pedersen & Houpt, 161 North Clark Street, Suite 3100, Chicago. Our host was Gregory Kazarian, Partner, Pedersen & Houpt. Our featured speaker at this meeting was Teresa Frisbie, Of Counsel, Davis, Mannix & McGrath and Steve Austermiller of the ABA/CEELI Program who visited from Zagreb, Croatia.

In their presentation "Bringing Mediation to the Balkans," they discussed the challenges of commercial arbitration and mediation in the Balkans.


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Thursday, April 24, 2003, 8:00:00 AM, at Altheimer & Gray, 40th Floor, 10 South Wacker Drive, Chicago. Our host was Louis Goldman, then Co-Chairman of Altheimer & Gray, and Chairman of its International Practice Group. Our featured speaker at this meeting was Sylwester Pieckowski, then a Partner in Altheimer & Gray's Warsaw Office, Vice President of the Polish Arbitration Association, and Deputy Director of the Warsaw Business Mediation Centre.

In his presentation "Business Mediation - A Chance for Poland," Mr. Pieckowski discussed the history, status and some of the challenges of commercial arbitration and mediation in Poland.

LaSalle St., Chicago. Our host was Javier Rubinstein, Mark Kadish and Hugh R. ("Rick") McCombs. Our featured speaker at this meeting was Richard Speidel.

Professor Richard Speidel of Northwestern agreed to speak to the CIDRA membership on the topic of the fit between the Illinois International Arbitration Act and the New York Convention, as implemented by the Federal Arbitration Act. He also discussed developments in California, which has also enacted the UN Model Law and concluded with the English Arbitration Act and its solution to the mesh between international and domestic arbitration law.

CIDRA sponsored international commercial arbitration training by the Chartered Institute of Arbitrators. CIDRA hosted a reception for the forty participants, the eight tutors, Tony Canham, the President of the Chartered Institute of Arbitrators, London and CIDRA members at 3:30 Friday afternoon at Northwestern. The reception was held in the faculty commons room overlooking Lake Michigan on the second floor of the Arthur Rubloff Building at 375 East Chicago Avenue, Chicago, Illinois. The participants were from all over North and South America as well as several people from the U.K. Also, congratulations to Pilar Gonzalez for doing a wonderful job in organizing this event. CIDRA has received a great deal of publicity from this event. Pilar sent thousands of electronic registration packets around the globe. We also sent out 1000 brochures printed by Northwestern. The mailing lists she compiled for us have been useful for the promotion of CIDRA as well.

Ram T. Madaan, Partner of Madaan & Co., (New Delhi & Chicago) and Adjunct Professor of International Business & Trade Law at The John Marshall Law School spoke about his background as an Indian Lawyer practicing in the U.S. and cultural issues arbitrators and mediators should be aware of when dealing with parties from India.


A meeting of the Chicago International Dispute Resolution Association Working Group was held on Thursday, March 21, 2002, 8:00:00 AM, at Sedgwick Detert Moran & Arnold, 209 S. LaSalle, Seventh Floor, Chicago. Our host was Jim Wangelin. Our featured speaker at this meeting was James Stück.

Our speaker was James Stück (description below) and the topic was "How International Management Consultants Approach Cross-Cultural Conflict Resolution." Jim Stück is Director of the Cross-Cultural Management division of Global Associates, located just outside Chicago. Jim works as a cross-cultural management consultant, trainer, and subject matter expert with Faculty status at Accenture, Faculty status with Carnegie Bosch Institute, and Adjunct Faculty status with McDonald’s Corporation’s Hamburger University. Other regular clients are Rockwell, FMC, UBS (Swiss), etc. In addition, Jim is an Associate Professor in Management and International Business at Valparaiso University, Indiana, Director of the Sino-American Management Institute (SAMI), and Managing Director of Roosevelt Institute for International Education, an international joint venture with Chinese partners. Prior to being a university professor, Jim worked for seven years as an international bank officer with J.P. Morgan Chase Bank and as an investment banker with Nagelvoort & Company, both on Wall Street, New York. Previously he worked for several years as an Assistant Country Manager with Educational Book Exhibits, Ltd., a British multinational, in Spain, India, and Nepal. He has articles and chapters published in Journal of International Business, Trade and Culture, Advances in Chinese Industrial Studies, The EDI Forum: Journal of Electronic Data Interchange, Journal of Teaching in International Business, and other publications. Jim speaks English and Spanish fluently, reads French, and has studied Chinese. His teaching and research have been honored by eight outstanding teacher awards, Kemper Foundation grants for international research, and an appointment as a Senior Fulbright Research Scholar.

Dick has been doing business in Arab countries for decades. He spoke to us about cultural issues U.S arbitrators and mediators should be aware of when dealing with Arab parties.

Steve Austermiller will speak to us about his recent ADR experiences working in Croatia. Members of the CBA International Law Committee or other interested persons are welcome to attend. There will be no December meeting.

Thanks to Brian Arbetter's organizing efforts, Jacqueline Piran will speak to us about cultural issues an American arbitrator or mediator should be aware of when dealing with a party from Germany. We will also discuss volunteering as arbitrators for the Vis competition and other new projects.

Dana Haviland has agreed to come speak to us about Onlineresolution.com. She is a very experienced international arbitrator and is using online dispute resolution tools in her practice. This will be a talk by Dana and a demonstration of the software, not a full blown training and there is no fee. Anyone interested in this may attend.

Liu Xiao Chun, a Chinese lawyer serving as a CIDRA intern and the General Manager of the Legal Department of Shun Yip Holdings Co., Ltd., spoke on the state of ADR in China and his experiences founding of the Shenzhen Arbitration Center, which is in China near Hong Kong.
